Lux Gatherings, L.P., doing business as PartyKroo (“PartyKroo”, “we”, “us”, or “our”) recognizes the importance of privacy. In this Privacy Policy (“Policy”), we describe how we collect, use, and disclose information that we obtain about visitors to our website www.partykroo.com (the “Site”) and the services available through our Site (collectively, the “Services”).

By visiting the Site or using any of our Services, you agree that any information that we collect from or about you through our Site, including Personal Information, anonymous information, and aggregate information (collectively, “Information”), will be handled as described in this Policy. We define “Personal Information” to mean personally identifiable information about an individual person, such as a name, address, email address, phone number, or other identifier that permits contacting of a specific individual.

Your use of our Site or Services, and any dispute over privacy, is subject to this Policy and our Terms of Use, including its applicable limitations on damages and the resolution of disputes. Our Terms of Use are incorporated by reference into this Policy.

We collect Information directly from you, from third parties, and automatically through your use of our Site or Services. We may combine all of the Information we collect about you from various sources.

  • Information We Collect Directly from You.
    The Information we collect directly from you depends on your role. For example, if you are a Host, we may collect information such as your name, email address, password, phone number, payment card information, and billing information; if you are a Server, we may collect information such as your name, Social Security number, tax identification number, email address, phone number, zip code, experience, photo, bio, skills, work history and password, as well as confirmation that you are over twenty-one (21) years of age.  We will also collect any other Information that you choose to provide to us, such as your schedule and availability, photos, information about your gathering, information to submit to a background check, and the contents of a message that you submit through our Site.
  • Information We Collect from Third Parties.
    We may collect Information about you from third parties, including, without limitation, from our Hosts, Servers, and other vendors (e.g., florists, party rental companies and companies providing background checks on Servers) (collectively, our “Affiliate Partners”) and social media platforms. For example, from our Affiliate Partners, we may collect Information about your purchases and orders (e.g., other party essentials you may order, such as flowers, alcohol or table linens).  From social media platforms, we may collect Information such as your log-in information, including your email address. As discussed in more detail in our Terms of Use, we may also collect background information about you from consumer reporting agencies.
  • Information We Collect Automatically.
    We automatically collect Information through your use of our Site using cookies and other technologies. This Information may include, without limitation, information about your operating system; settings and system configurations; IP address; device model; device ID and other unique device identifiers; the webpages you access within our Site; the website that led you to our Site; the website to which you go after leaving our Site; the number of times you access our Site, including the dates and times you do so; and other Site usage data.

How We Use Your Information

We use Information, including Personal Information, for the following purposes:

  • Providing Our Services.
    To provide our Site and Services; to improve our Site and Services; to develop new features, products, or services; to perform technical operations; and for other customer service purposes.
  • Tailoring Content.
    To tailor the content and information that we may send or display to you, and to otherwise personalize your experiences while using our Site or Services.
  • Communicating with You or Others.
    To communicate with you, including via email or, with your consent, via text message, about our Services and your use of them (e.g., we may send a text to a Server to confirm that s/he has been booked to serve at a party); to respond to your inquiries or complaints; to provide you with news, newsletters, or other information we think may interest you.
  • Marketing and Advertising.
    To provide you with special offers and promotions, including via email; to contact you about products or services we think may interest you; and for other marketing, advertising, and promotional purposes.
  • Analyzing Use of Our Services.
    To better understand how users access and use our Site and Services, both on an aggregated and individualized basis; to respond to user desires and preferences; and for other research, analytical, and statistical purposes.
  • Legal Compliance.
    To comply with applicable legal obligations, including as part of a judicial proceeding; to respond to a subpoena, warrant, court order, or other legal process; or as part of an investigation or request, whether formal or informal, from law enforcement or a governmental authority.
  • Protecting Our Rights and Interests.
    To protect our rights and interests and the rights and interests of other users of our Site and any other person, as well as to enforce this Policy and our Terms of Use.

How We Disclose Your Information

We may disclose Information, including Personal Information, with the following entities:

  • PartyKroo Users and Our Affiliate Partners.
    We may disclose Information to other PartyKroo users and our Affiliate Partners in order to provide our Services. For example, if you are a Host and book a Server for a gathering, we may share your contact information with the Server so s/he can contact you directly.
  • Corporate Affiliates.
    We may disclose Information to any current or future affiliates, parent companies, or subsidiaries.
  • Service Providers.
    We may disclose Information to vendors, service providers, agents, contractors, or others who perform functions on our behalf. For example, by providing Information through our Site, your Information may get disclosed to a payment card processor (such as Braintree) or a cloud service provider (such as Adobe).
  • Nonaffiliated Third Parties.
    We may disclose Information to our other nonaffiliated third parties. These third parties, as well as other PartyKroo users and Affiliate Partners, may use such Information for their own marketing purposes. Please see our Special Information for California Consumers section below with regard to such disclosures.

We may also disclose Information, including Personal Information, for the following purposes:

  • Business Transfers.
    We may disclose your information to another entity in connection with, including during negotiations of, an acquisition or merger, sale or transfer of a business unit or assets, bankruptcy proceeding, or as part of any other similar business transfer. If the surviving entity involved in such a transfer is not Lux Gatherings, L.P., the surviving company may use the information we collect about you pursuant to its own privacy policies, which may be different from this Policy.
  • Legal Compliance.
    We may disclose Information in order to comply with the law, regulation, a judicial proceeding, subpoena, court order, or other legal process, including informal law enforcement or governmental requests for information.
  • Protecting Rights and Interests.
    We may disclose Information where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or as evidence in litigation in which we are involved.
  • Aggregate and De-Identified Information.
    We may disclose aggregate, anonymous, or de-identified information about users for marketing, advertising, research, or other purposes.

Cookies and Other Tracking Mechanisms

We and our service providers use cookies and other tracking mechanisms to track your use of our Site or Services.

  • Cookies.
    We or our service providers may use cookies to track visitor activity on our Site, such as the pages visited and time spent on our Site. A cookie is a text file that a website transfers to your computer’s hard drive for record-keeping purposes. Most browsers allow users to refuse cookies. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our Site who disable cookies may not be able to browse certain areas of the Site.
  • Clear GIFs, pixel tags and other technologies.
    Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies, which are embedded invisibly on web pages. We or our service providers may use clear GIFs (also known as web beacons, web bugs or pixel tags), in connection with our Site to track the activities of visitors to our Site, help us manage content, and compile statistics about usage of our Site. We or our service providers may also use clear GIFs in HTML emails to our users, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.
  • Local Storage Objects.
    We may use Flash Local Storage Objects (“Flash LSOs”) to store your Site preferences and to personalize your visit. Flash LSOs are different from browser cookies because of the amount and type of data stored. Typically, you cannot control, delete, or disable the acceptance of Flash LSOs through your web browser. For more information on Flash LSOs, or to learn how to manage your settings for Flash LSOs, go to the Adobe Flash Player Help Page, choose “Global Storage Settings Panel” and follow the instructions. This enables us and these products and services in which you might be interested.

Third-party ad network providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third-party cookies and other technologies are governed by each third party’s specific privacy policy, not this one. We may provide these third-party advertisers with information, including Personal Information, about you.

Users in the United States may opt out of many third-party ad networks. For example, you may go to the Digital Advertising Alliance (“DAA”) Consumer Choice Page for information about opting out of interest-based advertising and their choices regarding having information used by DAA companies. You may also go to the Network Advertising Initiative (“NAI”) Consumer Opt-Out Page for information about opting out of interest-based advertising and their choices regarding having information used by NAI members.

Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will opt you out from those companies’ delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through our Site or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on the DAA or NAI websites, your opt out may not be effective. User-Generated Content

You may upload or transmit text, graphics, photos, videos, or other materials to the Site (collectively, “Content”). If you post Content on our Site, the Content, as well as other information, such as your user name and profile picture, may be available to all visitors to our Site, and we cannot prevent such information from being used in a manner that may violate this Policy, our Terms of Use, the law, or your personal privacy.

Please note that any Information or materials posted to a third-party website (e.g., posting photos to Instagram of a gathering where PartyKroo Servers are working) are subject to the privacy policy of that third party.

Our Site and Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy but instead is governed by the privacy policies of those third-party websites. We are not responsible for the information practices of such third-party websites.

Security

We have taken steps to help protect the Personal Information we collect about you from loss, misuse, unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee 100% security.

If you have an account with us, you should take steps to protect against unauthorized access to your account by, among other things, choosing a robust password that nobody else knows or can easily guess and keeping your login information and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

Your Choices

You may modify the Personal Information that you have submitted by updating your profile on our Site or emailing us at support@partykroo.com.

We may send periodic promotional or informational emails to you. You may opt out of such communications by following the opt-out instructions contained in the email. Please note that it may take up to ten (10) business days for us to process opt-out requests. If you opt out of receiving emails about recommendations or other information we think may interest you, we may still send you emails about your account or any Services you have requested or received from us.

Children

Our Site is not targeted to children under thirteen (13) years of age. If we discover that a child under thirteen (13) has provided us with Personal Information, we will promptly delete such Personal Information from our systems.

Special Information for California Consumers

California residents may request a list of certain third parties to which we have disclosed personal information, as defined in California’s “Shine the Light” law (Cal. Civ. Code § 1798.83), about you for their own direct marketing purposes. You may make one request per calendar year.
